Got my $3,395 refund

There is a law that, if a company or person is selling something outside their place of business... be it at your home, in a hotel, or whatever, that you have a 3 day right to recind. The terms of the recision are spelled out on the back of a ClickIncome contract. If you decide to cancel, follow their instructions exactly. In my case, because I bought the whole package, there were actually three different agreements / contracts that I had to cancel, and all three had to be put in seperate envelopes and sent out certified mail. The addresses were all the same, but they went to 3 different suites in the same office building.
Then, after all that was done I forwarded copies of everything I did to the law office. He said that, in the event that it had to go to court, I would have to use a referral law firm out of Utah because they couldn't practice law in Utah. Fortuantely I have had this legal service for almost 20 years and, in the event that I do go to court, I will have coverage.
So, just a word to the wise... if you are going to cancel, make sure you do it according to the specific terms of cancellation and within the time frame (3 business days) that they specify. Also, in case you didn't know (I didn't), Saturday is considered a business day, at least in California. Since most of these seminars occur on the weekend you may need to take that into consideration.
MY REPLY TO DREAMWEAVER'S POSTING
Big time thanks dreamweaver. Your careful advise worked. Otherwise I would not have realised that I had to send in 3 letters of cancellation and how very careful I had to be.
1. Took seminar at the end of Oct. Decided I wanted to cancel after reading about Clickincome on the internet. Sent in 3 cancellation letters -certified mail-the next day after the seminar. Also notified my credit card company and they opened a dispute for the $3,995.
2. Got about 6 phone calls in the next 2 weeks, with different offers to get me to not cancel. One of the offers was half price for same program.
I held firm and said I want to cancel.
3. Called Clickincome after I got back the certified mail confirmations from the post office.
4. Clickincome said they did not have any record of my cancellation letters or certified mail receipts. They asked me to fax copy of my certified mail receipts.
At this time I sent official complaint to Utah Better Business Bureau
5. I faxed copies of post office receipts and waited a day and called them again. They still had not received the fax and asked me to re-fax receipts to them.
6. Called the next day and they found the fax (first one) but still could not find the cancellation letters. I asked for information of where to mail the materials back to and they said they had to find the letters before they would send me a letter. I offered to re-mail or fax copies of the letters. They said no, as the post office receipts proved that I had sent them something, but they had to find what I had originally sent them. I could not get my refund until I sent back the materials and they were making it a very difficult process.
7. Call the next day again and asked if the letters had been found. They had not, but assured me that I would get the letter of where to send the material within the next week or two.
8. 6 days later I finallllllllllllllly got the letter and sent the materials back.
9. 5 days later got e-mail receipt from post office that box had been received.
10. 2 days later TODAY refund was posted to my credit card! Was really surprised, as they had 30 days after receipt of material to post to my account. Maybe Credit Card dispute and letter to Utah Better Business Bureau helped grease the wheels. |
